Terms of Service

These terms form an agreement between you and NextPath Ventures LLC, trading as FamilyLetter. By creating an account or subscribing you accept them. They include an arbitration agreement and a class-action waiver, which affect how disputes are resolved — you can opt out of arbitration within 30 days, and the section explaining how is below.

Who can use FamilyLetter

Account holders and people who join directly through an invite must be at least 18 and able to enter a binding contract. A parent or guardian may submit content about a child on the child's behalf. You are responsible for activity under your account and for keeping your login secure. The information you give us must be accurate, particularly any mailing address used for fulfillment.

What the service does

FamilyLetter provides tools for an account holder and invited contributors to collect photos and messages, assemble a postcard, and review and approve it. Recurring contributor prompts and physical print-and-mail fulfillment may be enabled in stages or may not yet be available for every account.

When physical fulfillment is available, we do not intentionally submit a postcard for printing without the account holder's approval, and we do not intentionally submit an empty postcard.

Inviting family members

You invite family members by sharing a link. You do not give us their phone numbers, and we do not text anyone on your say-so.

Whoever opens that link decides for themselves whether to take part. They enter their own name and their own mobile number, confirm that number, and accept these terms, our privacy policy and our text messages before we send them anything. If they do not complete that, they are not contacted.

Share the invite link only with people you would expect to want it. Do not post it publicly, and do not enter another person's phone number on their behalf.

Anyone can revoke consent to recurring messages at any time. We process opt-outs promptly and do not resume recurring messages without new consent where required.

You agree to indemnify us for any claim, penalty, loss or cost arising from your misuse of the invite link or from a number entered on someone else's behalf, including claims under the Telephone Consumer Protection Act or any similar law.

FamilyLetter SMS program

FamilyLetter may send recurring automated service text messages to an adult who enters and verifies their own mobile number and affirmatively agrees to receive them. These messages request a photo or note for a private family postcard, provide contributor progress, send daily reminders while an update is due, or notify an account holder that a postcard is ready to review and send. We do not use this program for marketing or age-restricted content.

Message frequency varies, up to seven messages per monthly postcard cycle for each family, plus one confirmation when you opt in. Contributors receive no more than one opening prompt and four daily reminders in a cycle. Message and data rates may apply. Reply STOP to cancel at any time. Consent to receive recurring text messages is recorded separately from acceptance of these Terms and the Privacy Policy. Text messaging originator opt-in data and consent will not be shared with third parties.

Carriers are not liable for delayed or undelivered messages.

Children in your family

FamilyLetter is for adults. Do not share the family invite link with a minor. We do not ask a joining contributor's age, so we rely on you not to.

If you want a child's photograph or words on a postcard, add them to your family yourself and submit on their behalf. By doing so you confirm that you are the child's parent or guardian, or that you have their parent or guardian's permission.

A parent or guardian can ask us at any time to show what we hold about their child, correct it, delete it, stop us collecting anything further, or remove a child who has joined a family. Tell us and we will act on it.

Your family's content

The photos and messages your family submits remain yours. You grant us a limited, non-exclusive licence to store, process, display and, when fulfillment is enabled, print and mail them as needed to provide the service. The licence ends when the content is deleted from our active systems, except where retention is reasonably necessary for legal, security, backup or dispute purposes.

We will not use your family's content to advertise the service, will not make it public, and will not use it to train machine-learning models. The handwritten look on a postcard comes from preset typefaces — we do not capture or reproduce anyone's actual handwriting.

You are responsible for having the right to submit what you submit, including photographs taken by someone else and images of people who have not consented to appear. We may refuse or remove content that is unlawful or infringing, and may decline to print a postcard on that basis.

Subscription, automatic renewal and cancellation

FamilyLetter is a subscription that renews automatically until you cancel. Before you are charged we show the price, the billing frequency and the renewal terms, and you must expressly agree to the recurring charge.

Monthly plans renew each month and are billed in advance. Annual plans renew each year and are billed in advance. Payments are processed by Stripe. The checkout page describes the features, household allowance and any fulfillment included in the selected plan.

You can manage or cancel an active subscription online through the billing page and Stripe's hosted portal. A cancellation normally stops the next renewal while access continues through the paid billing period, unless the portal states otherwise. If the portal is unavailable, contact support and we will help process the request.

Cancellation does not by itself refund the current billing period. We provide renewal or other subscription notices when required by applicable law.

We may change prices for future billing periods. We will tell you before a change takes effect, and you can cancel if you do not accept it.

Printing and delivery

When print-and-mail fulfillment is enabled, an approved postcard may be submitted to our fulfillment provider. Once a postcard is accepted for production, it generally cannot be recalled, edited or cancelled.

Delivery is by postal mail. We do not control postal timing and cannot guarantee a delivery date. We are not responsible for postal delays or loss, or for mail that cannot be delivered because an address supplied to us was wrong or out of date.

Acceptable use

Do not use FamilyLetter to send unlawful, harassing, hateful, obscene or infringing material, to share the invite link with people who would not want it, to impersonate anyone, or to interfere with the service or its security. We may suspend or close an account that does, and may withhold a postcard that would breach this section.

Suspension and termination

You may contact us to request account closure. We may suspend or close an account that breaches these terms, that we reasonably believe is being used unlawfully, or where we are required to. Refunds, if any, are provided as required by law or as we otherwise agree.

Disclaimers

The service is provided on an as-is and as-available basis. To the fullest extent permitted by law we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose and non-infringement. We do not warrant that the service will be uninterrupted, timely, secure or error-free, or that every contributor will respond.

Limitation of liability

To the fullest extent permitted by law, neither party is liable for indirect, incidental, special, consequential or punitive damages, or for lost profits or lost data, arising from the service.

Our total liability for all claims relating to the service in any twelve-month period is limited to the amount you paid us in the twelve months before the event giving rise to the claim.

Some states do not allow certain limitations, so parts of this section may not apply to you. Nothing here limits liability that cannot lawfully be limited.

Indemnification

You agree to indemnify and hold harmless FamilyLetter and its officers and staff from claims, damages, penalties and reasonable legal costs arising from your breach of these terms, from content your family submitted that you had no right to submit, or from your misuse of the invite link.

Dispute resolution, arbitration and class-action waiver

Please read this section carefully. It affects how disputes between us are resolved.

First, talk to us. Most problems are resolved quickly by contacting support, and both of us agree to try to resolve a dispute informally for 30 days before starting a formal proceeding.

If that does not resolve it, you and we agree that any dispute arising out of or relating to these terms or the service will be resolved by binding individual arbitration administered by a recognised arbitration provider under its consumer rules, rather than in court. The arbitrator decides the dispute, and judgment on the award may be entered in any court with jurisdiction.

You and we each waive the right to a jury trial and the right to participate in a class, collective, consolidated or representative action. The arbitrator may not consolidate claims or preside over any form of representative proceeding. If this waiver is held unenforceable as to a particular claim, that claim proceeds in court and the rest of this section still applies.

Either of us may bring an individual claim in small-claims court instead, if it qualifies. Nothing here prevents either party from seeking injunctive relief in court to protect intellectual property or to stop unauthorised use of the service.

You may opt out of arbitration. Send us written notice within 30 days of first accepting these terms saying you opt out, with your name and the email address on your account. Opting out has no effect on your subscription or any other part of this agreement, and we will not treat you differently for doing it.

Governing law

These terms are governed by the laws of Delaware, without regard to conflict-of-law rules. Where a dispute is not subject to arbitration, it will be brought in the courts of Delaware, and both parties consent to that jurisdiction. Nothing in this section deprives you of the protection of mandatory consumer laws in the state where you live.

Changes to these terms

We may update these terms and will change the effective date above. Where required by law, we will provide additional notice of a material change before it takes effect. If you do not accept an update, you may stop using the service and cancel an active subscription.

General, and how to contact us

If any provision of these terms is held unenforceable, the rest remains in force. Our not enforcing a term is not a waiver of it. You may not transfer this agreement without our consent; we may transfer it in connection with a sale of the business. These terms, with the privacy policy, are the entire agreement between us about the service.
